Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ChopVid website, applications, and related services (collectively, the "Service") provided by ChopVid ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
ChopVid helps users create short-form video clips from publicly available YouTube content, subject to technical limits, fair use of infrastructure, and the features available on your subscription tier. We may modify, suspend, or discontinue features with reasonable notice where practicable, or immediately where required for security or legal reasons.
2. Eligibility and accounts
You must be at least the age of digital consent in your jurisdiction (and in any case at least 16 years old) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.
3. Acceptable use
You agree not to:
- Use the Service in violation of applicable law or third-party rights;
- Circumvent or attempt to circumvent usage limits, authentication, billing, or security controls;
- Upload, request processing of, or distribute content that is unlawful, infringing, harassing, hateful, or that contains malware;
- Probe, scan, or test the vulnerability of our systems without authorization, or interfere with the Service or other users;
- Use automated means to access the Service in a manner that imposes an unreasonable load or violates our technical documentation;
- Resell or redistribute the Service without our prior written consent.
We may suspend or terminate access for conduct that we reasonably believe violates these Terms or creates risk for the Service or other users.
4. Third-party content and platforms
The Service may process content made available through third-party platforms (for example, YouTube). You are solely responsible for ensuring that your use of source material and generated clips complies with the terms, policies, and intellectual property rights of those platforms and of any rights holders. ChopVid does not claim ownership of third-party content; we provide tools only.
5. Intellectual property
The Service, including its software, branding, documentation, and visual design, is owned by ChopVid and its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal or personal content-creation purposes. You may not copy, modify, reverse engineer, or create derivative works of our software except where permitted by law.
As between you and ChopVid, you retain rights in content you provide. You grant us a worldwide license to host, process, transmit, and display such content solely as needed to operate and improve the Service, including storage and transcoding on our infrastructure.
6. Fees and subscriptions
Certain features require a paid subscription. Fees, billing cycles, and renewal terms are presented at checkout and in your account. Unless stated otherwise, subscriptions renew automatically until canceled. Payments are processed by our payment provider; you agree to their terms and privacy policy where applicable. Taxes may be added as required by law.
You may cancel your subscription in accordance with the cancellation flow in your account. Unless required by law or expressly stated at purchase, fees are non-refundable except at our discretion.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUTS WILL MEET YOUR EXPECTATIONS OR COMPLY WITH ALL PLATFORM RULES.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL CHOPVID OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
9. Indemnity
You will defend, indemnify, and hold harmless ChopVid and its affiliates, officers, and employees from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms or applicable law.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms, fail to pay fees when due, or if we are required to do so by law. Provisions that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnity) will survive termination.
11. Governing law and disputes
These Terms are governed by the laws of the United States and the State of Delaware, excluding conflict-of-law rules. You and ChopVid agree to the exclusive jurisdiction of the state and federal courts located in Delaware for disputes arising from these Terms or the Service, subject to mandatory consumer protections in your jurisdiction where they cannot be waived.
12. Changes to these Terms
We may revise these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. If a change is material, we will provide additional notice as appropriate (for example, via email or an in-product notice). Your continued use after the effective date constitutes acceptance of the revised Terms.
